Welcome to Potato Stop. These Terms and Conditions govern your use of our website (potatostop.com), the Potato Stop mobile app, and our ordering services. By accessing or using our services, you agree to be bound by these Terms.

1. Agreement to Terms

By accessing our website or app, placing orders, or using our services, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with any of these terms, please do not use our services.

Our Privacy Policy explains how we collect and use your personal information and forms part of these Terms.

2. Use of Services

Potato Stop lets you browse our menu and order food online from participating Potato Stop locations. We reserve the right to:

• Modify or discontinue any portion of our services without notice
• Refuse service to anyone for any lawful reason
• Limit the availability of services to any person, geographic area, or jurisdiction
• Establish additional terms for specific services or promotions

You agree not to misuse our services, including by placing fraudulent orders, interfering with the website or app, or attempting to access accounts or data that are not yours.

3. Your Account

Some features, such as saved cards, order history, and rewards, require an account. You can create one with your email address and a password, or sign in with your Google account or Apple ID. When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password, or access to your Google or Apple account, secure
• Accept responsibility for all activities that occur under your account
• Notify us promptly of any unauthorized use of your account

If you sign in with Google or Apple, your use of that sign-in is also subject to Google's or Apple's own terms. You may delete your account at any time, as described in our Privacy Policy. We may suspend or disable an account if we believe you have violated these Terms.

4. Orders, Pricing, and Payment

• Menu items, prices, and availability vary by location. The prices shown are those of the store you have selected.
• All items are subject to availability. If an item becomes unavailable, we may cancel or adjust that part of your order.
• Prices may change without notice, but a change will not affect an order you have already placed.
• Applicable sales taxes are added at checkout.
• You agree to provide accurate order and payment information and represent that you are authorized to use the payment method you provide.
• Card, Apple Pay, and Google Pay payments are processed by our payment processor, Square. If you save a card, it is stored by Square for future orders.
• We may refuse or cancel an order if fraud or an unauthorized transaction is suspected, or if an item was listed with an obvious pricing error. If we cancel a paid order, we will refund you.

5. Pickup

• Online orders are prepared for pickup at the store you selected. Please check the store and pickup time before placing your order.
• Ready times are estimates and may vary when the store is busy.
• Please collect your order promptly. Food is prepared fresh and its quality may decline if it is left uncollected; we are not responsible for orders that are not picked up.
• Where delivery is offered, it may be provided by a third-party delivery service under its own terms, and additional fees may apply.

6. Cancellations and Refunds

Because we start preparing food shortly after an order is placed, orders generally cannot be changed or cancelled once submitted. If there is a problem with your order, such as a missing or incorrect item, please contact the store or us as soon as possible. Approved refunds are returned to the original payment method, and the time for them to appear depends on your bank or card issuer.

7. Rewards, Promotions, and Gift Cards

• Rewards: Reward points earned through the app are tied to your account, have no cash value, cannot be transferred or sold, and may expire as shown in the app. We may change or end the rewards program, but we will honor rewards you have already redeemed.
• Promotions and coupons: Offers, coupons, and welcome gifts are subject to the terms shown with the offer, may be limited to certain locations, items, or one use per customer, and cannot be combined unless stated.
• Gift cards: Gift cards can be used toward purchases at participating locations and cannot be redeemed for cash, except where required by law. Please treat a gift card like cash; we are not responsible for lost or stolen gift cards.
• We may cancel rewards, promotions, or gift card balances obtained through fraud or misuse.

8. Allergens and Nutrition

Our food is prepared in shared kitchens where it may come into contact with common allergens, including milk, eggs, wheat, soy, peanuts, tree nuts, fish, shellfish, and sesame. We cannot guarantee that any item is free of allergens. If you have a food allergy or dietary requirement, please ask the store before ordering. Product images are for illustration and the actual items may vary.

9. Intellectual Property

The Potato Stop name, logo, website, and mobile app, including text, graphics, images, and software, are owned by or licensed to Potato Stop and are protected by copyright, trademark, and other intellectual property laws.

You may not:

• Use our trademarks or service marks without prior written consent
• Copy, modify, distribute, or create derivative works of our content
• Use our content for commercial purposes without express permission
• Attempt to reverse engineer any software contained in our website or app

10. User Reviews and Content

If you submit reviews, comments, or other content to our services:

• You grant us a non-exclusive, royalty-free, perpetual right to use, reproduce, modify, adapt, publish, and display such content
• You represent that you own or control all rights to the content you submit
• You agree not to submit content that is illegal, abusive, harassing, defamatory, or otherwise objectionable
• We may remove any content at our discretion

11. Disclaimer and Limitation of Liability

Our website and app are provided "as is" and "as available". We do not guarantee that they will always be available, uninterrupted, or error-free.

To the maximum extent permitted by law, Potato Stop and its affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Lost profits, revenue, data, or business opportunities
• Damages resulting from unauthorized access to your account that is not caused by us
• Any interruption or cessation of services

To the maximum extent permitted by law, our total liability for any claim arising from these Terms or our online services shall not exceed the amount you paid for the order giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Potato Stop, its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising from your misuse of our services, your violation of these Terms, or your violation of any rights of another.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising out of these Terms shall be brought in the state or federal courts located in Los Angeles County, California, unless the law of your place of residence requires otherwise.

14. Changes to Terms

We may update these Terms from time to time. The updated version will be indicated by an updated "Last Updated" date and takes effect when posted. Your continued use of our services after any changes indicates your acceptance of the revised Terms.

15. Termination

We may suspend or terminate your account and access to our services if you breach these Terms or misuse our services. You may stop using our services and delete your account at any time. Sections that by their nature should survive termination, such as limitation of liability and indemnification, will continue to apply.
